Mossberg 590 Shockwave

Post by bbc80malibu » Mon Feb 13, 2017 6:55 pm

Will the Mossberg 590 Shockwave be legal for sale in Wa? Is there any RCW that would prevent the sale of them?
I want one, but I'm getting mixed information from different gun shops, but no one has proof in black and white.

(23) "Short-barreled shotgun" means a shotgun having one or more barrels less than eighteen inches in length and any weapon made from a shotgun by any means of modification if such modified weapon has an overall length of less than twenty-six inches.
http://app.leg.wa.gov/RCW/default.aspx?cite=9.41.010

Unlawful firearms and parts contraband.
All machine guns, short-barreled shotguns, or short-barreled rifles, or any part designed and intended solely and exclusively for use in a machine gun, short-barreled shotgun, or short-barreled rifle, or in converting a weapon into a machine gun, short-barreled shotgun, or short-barreled rifle, illegally held or illegally possessed are hereby declared to be contraband, and it shall be the duty of all peace officers, and/or any officer or member of the armed forces of the United States or the state of Washington, to seize said machine gun, short-barreled shotgun, or short-barreled rifle, or parts thereof, wherever and whenever found.

RCW 9.41.190
Unlawful firearms—Exceptions.

This statement from Mossberg would need to be clarified...
"Classified as fully-compliant by the BATFE, this model requires no Tax Stamp for transfers."
It may fall under the exceptions RCW.

IAW this article, It's classified under federal law just a firearm like a strip lower receiver.

http://www.alloutdoor.com/2017/02/08/sh ... shockwave/

One advantage of the Mossberg product is that since they are factory built on virgin receivers they are classified as “firearms” and not “Short Barreled Shotguns” or even “Any Other Weapons.” This means they are transferred as regular Title 1 firearms and do not require any additional taxes or special permits under Federal law. (State laws may vary.)

With that, I would guess that in Wa, a 14" barrel would be illegal to own. :(

I was looking into this a while back. As far as I could tell, it is legal.

You can buy an AOW type shotgun in Washington so this should be good to go.

Correct me if I'm wrong but a shotgun must be shouldered and a shockwave doesn't have a stock.
Help make short barrel shotguns legal.

"a shotgun must be shouldered"? What would make you think that? :?

There was a bit of a run around on this guy over on AR15.com in the WAHTF. General consensus was that since the receiver has never had a shoulder stock on it its legal, same case as AR and AK pistols, so long as a shoulderable stock never touches the receiver youre good to go. However I think its still a good idea to contact a local gun shop that sells this sort of thing, they may have more information.

I held one at Protection First. I have to say it is certainly more comfortable to hold then my 500 with a pistol grip. It is a very handy size too and I could see this being a great little shotgun for a truck or home defense. There was a gentleman in there that had one already and said the grip needed some texture. He was talking about a stipple job or a slip on grip.

Most gun shops are the last place I would go for legal advice. These are clearly legal and available in Washington
