Carrying in Spokane City Parks
I was walking my dog in a local park a few days ago and saw a sign that said it was a no drugs and no gun zone. I looked into it a bit more and on the list of rules it stated that weapons were not allowed in the park, and at the bottom of the list of rules it referenced SMC 10.10.040. However, my understanding from the state regulations is that the city doesn't have the authority to limit carrying because the state preempts all local restrictions (RCW 9.41.290) and the state doesn't restrict access in parks. Do you folks have any clarification on this inconsistency?

Check to see that it is not part of school grounds, or is being used exclusively by a school - state and federal law prohibits (illegally) firearms there.
Other than that, the Spokane code is toothless in regard to firearms.

There is no school nearby, it appears to be a part of the Spokane Municipal Code. It's kind of annoying because it seems like it should be toothless but I would not want to be the one to take it to court to get it overturned.

Lots of old signs posted at the parks that the city is too lazy to take down. Besides, they think that "a sign" is the best way to protect the sheepeople whether it's an accurate sign or not. Criminals are afraid of signs you know...

Friendship park had them up when I lived close by. I ignored them and obviously the drug dealers did too.

The last time I ran into that I rented the shelter at Manito Park and had an open carry picnic in the park. I called the local TV stations, Inlander, Spokesman Review and several radio stations as well as the SPD and told them we would be there, give it a try posting here has almost no value.
