NFA trust Attorney

Has anyone in Spokane used an attorney to draft a Trust for NFA items? How was your experience and. What did it cost you?
My brother paid $500, but an Attorney that I contacted quoted me $900 today. That seems outrageous. Most of what I have read says that around $500 is correct for the amount of work involved. I would prefer using an attorney so that the Trust is designed specifically for my needs.

Any help is appreciated.

You might give Matt at Tier1 a call, should be able to help you out.

Didn't Obama's Executive Orders announced Tuesday make some significant changes to the NFA Trust rules? Seems like I read that everyone named as trustee has to undergo a full BGC at least once, maybe annually, and every time a new item gets added to the trust's assets?
Always looking for a deal on more ammo and reloading components.

When 41F the new name for 41P takes effect it will not be retroactive. That is all applications submitted under the current rules will continue to be processed. In addition, there is no requirement to comply with the new rules for previously approved applications or legal entities like Gun Trusts. On page 198 ATF states “The final rule is not retroactive and therefore the final rule will not apply to applications that are in ‘pending’ status, or to previously approved applications for existing legal entities and trusts (Gun Trusts) holding NFA items.”

Just an update. I got a recommendation from a friend to contact Alan C. Baker; who is an attorney in Lewiston, ID. He is licensed to practice in Washington and Idaho. He set up a trust for my friend Grant. Grant told me that Alan sends regular email updates about law changes, proposed legislation and any other Trust related info that comes up. I set up an appointment, and talked with Alan for 45 minutes. He answered all of my questions, and explained a lot of things I didn't understand. At the end of the conversation he told me that I had no obligation to use him for a trust despite our conversation, and there was no charge for the consult. He said most things can be done over the phone, by mail or by email so driving down shouldnt be needed; unless you prefer a face to face interaction. He also explained that any NFA items that I want to add, remove, or transfer he would take care of for no additional cost from here on. Same goes for Trustees and beneficiaries, and questions about future laws and ATF policy changes. I have chosen to use Alan because of this, and the fact that this is the experience that Grant has had with Alan since his Trust was created. I mailed my check and signed contract this morning.
This is my experience and I cannot guarantee that you will have the same experience. I do recommend calling or emailing him if you are interested in a Trust. I will try to remember to post more info once my Trust is completed. I was quoted $500, which I feel is a bargin considering everything that he may do in the future. The document is a "GunDocx Silver" package. This can be purchased online for the same price. However, I feel much better knowing that I have a qualified person who will answer my questions and will file ATF forms for me. I do not want to risk losing my rights because I was ignorant of the process or of any law/policy.

Another quick update. Got off the phone with Alan about an hour ago. He spent an hour with me going over the details of the Trust so he can put it together. It will be completed tomorrow and he will email (my choice to speed things up) me everything for review. Once everything is signed and notarized, he will send a binder with a hard copy, an electronic copy and some completed forms to use as a template to show how to complete forms for purchase/transfer. After going over all the details and choices that can be made, I am very relieved that I chose to go this route. There are so many choices with Trustees and beneficiaries, laws and regulations about who controls what; what can be transferred to whom and to where. I would not have known any of this had I gone at it alone. I am not going into much detail because this is a service that he charges for; and how he makes his living. I highly recommend at least calling him and having a consultation if you are considering a Trust or the purchase of any NFA item.

On a side note; I purchased a 10.5" upper before speaking with him, not knowing that it is illegal to build one here in Washington. Not sure if I will make it a pistol or find some way to have it completed as an SBR. MEH.

Just got done reviewing my trust. I couldn't believe how much is involved in this process. I have very little knowledge of legal documents and I was definitely nieve in thinking this would be a simple, couple page document. The final Trust will be about 43 pages, and covers about any scenario you could think of. Some examples are death/incapacitation, divorce, lawsiuts, changes in Trustees & Beneficiaries and changes in laws, among many others. A Trust will answer many of your questions; but also bring up new questions that you probably havn't considered. I'm glad I have a resource to contact regarding these questions. If you are someone that is more familiar with this process or have a good knowledge of NFA and State firearms laws; you could probably do this on your own. This is an investment that I'm glad I made, and I feel my assets will be better protected because of it. Regardless of what route any of you take, do your research before spending money. Get some opinions from independent sources; not just from those that stand to benefit from selling you a product. Good luck to you. I hope someone is able to benefit from this somehow.

I finally got my SBR paperwork off today. I provided Alan with the Manufacturer and Serial number today and he filled out all the paperwork and had it back to me in under 2 hours. I just printed, signed and dated everything and dropped it in the mail. This was after he answered 14 emails full of questions about the process from me over the last 3 weeks. He is very knowledgeable and has incredible patience. I think he would be a great asset for anyone considering a trust.

Just another update. Got my Stamp back for my SBR on July 20th; which was 1 year and 8 days from when I filed. I guess thats my fault for filing on the eve of Obama's 41F changes. Sure nice to have it though!
I also filed paperwork for my first suppressor the same day i got my stamp. (July 20)
Hopefully the wait wont be as long this time.
I used Silencer Shop (online). It was pretty simple. Just uplaoded a .pdf of my trust, a passport style photo and went to Tier 1 guns to use the finger print machine and upload them to Silencer Shop. I believe Matt is his name at Tier 1, but im not positive. He is a great guy. Very nice, helpful and patient. If you live close, check him out.

Over the past year Alan has been continually answering questions, filling out paperwork and keeping my file/Trust up to date. One of my Trustees lives in another state and the transportation issue is being resolved now that my SBR is legal and built. Im still very happy with the service he provides. He is a great asset. If you are remotely considering a trust, I would suggest giving him a call.

Just another update. Just got paperwork in the mail from Alan for my change of address and the form to transport my SBR to my brothers place in Idaho. (Must be done annually if you want to transport an NFA item out of state) Alan had everthing prepared and all i had to do was sign. He even included another envelope postage paid and addressed for the ATF. If anyone has questions about a Trust, contact him!
